Before that, she was former Gov. John Hickenlooper\u2019s liaison to Washington, D.C., and she worked as a voting rights attorney for President Barack Obama\u2019s 2012 campaign. Griswold lives in Louisville.<\/p>\n<p><strong>David Seligman<\/strong>, 43, is the executive director of Towards Justice, a legal nonprofit that specializes in workers rights. Before that, he worked as an attorney at the National Consumer Law Center in Boston. Seligman lives in Denver.<\/p>\n<p><strong>Michael Dougherty<\/strong>, 54, has served as the district attorney for Boulder County since 2018. He has also worked as an assistant district attorney in Colorado\u2019s first judicial district, and in Manhattan, New York. He served as Colorado\u2019s deputy attorney general in charge of the office\u2019s criminal section from 2010 to 2013. Dougherty lives in Boulder.<\/p>\n<p><strong>Hetal Doshi<\/strong>, 47, served as the deputy assistant attorney general for the Department of Justice during the Biden administration, where she led the antitrust unit. Before that, she was a federal prosecutor in Colorado for the U.S. Attorney\u2019s Office. How would you put your stamp on the agency? Are there areas that you would prioritize more or less than others?<\/h4>\n<div>\n<div>\n<p><strong>Jena Griswold<\/strong><\/p>\n<p>\u201cFirst, I will fight back against Donald Trump and his attacks on our democracy,\u201d Griswold said, adding that she would protect Coloradans\u2019 civil rights from a \u201clawless Trump administration\u201d and \u201cinhumane immigration policies.\u201d<\/p>\n<p>She pledged to \u201cstaff up an office on workers\u2019 rights to protect Coloradans from wage theft and illegal behavior.\u201d And she said she would protect women\u2019s access to reproductive healthcare, including birth control, IVF and abortions. On public safety, she said she would help pass a stronger ban on assault weapons and work to fix the rape kit backlog.<\/p>\n<\/div>\n<div>\n<p><strong>David Seligman<\/strong><\/p>\n<p>Seligman said he would prioritize protecting immigrants and holding federal immigration enforcement officers accountable for violating civil rights. He also promised to hold corporations accountable for things like \u201cburying us in junk fees,\u201d \u201csuing people for medical debt they don\u2019t even owe,\u201d and increasing utility rates. \u201cThe forces of wealth and power are ripping us off, and they\u2019re getting away with it.\u201d Finally, he said he would prioritize \u201cthe existential threat\u201d of climate change. \u201cWe need to make polluters pay,\u201d he said.<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>Michael Dougherty<\/strong><\/p>\n<p>\u201cWith the Colorado River Compact coming to an end this year, the scarcity of water due to climate change, and the Trump administration rolling back the Environmental Protection Agency, the next attorney general has to step up,\u201d Dougherty said. He also wants to prioritize consumer protection and prosecuting public corruption in response to lax enforcement by the Trump administration. Finally, he said, \u201cover the last few years, public safety has suffered in Colorado. I\u2019m going to reprioritize public safety and make sure the attorney general\u2019s office is supporting law enforcement and local district attorneys.\u201d<\/p>\n<\/div>\n<div>\n<p><strong>Hetal Doshi<\/strong><\/p>\n<p>Doshi said her top priority would be \u201cdefending Colorado and protecting the rule of law \u2014 anything that touches on our constitutional rights, our right to vote, our right to make decisions about our bodies.\u201d She also said she wants to use the AG\u2019s office to address the underlying socioeconomic problems that led to President Trump\u2019s reelection. \u201cWhether that\u2019s consolidation in Big Ag, or the healthcare space, or it\u2019s making sure that our workers have access to fair wages \u2026 I\u2019m going to use every tool at my disposal\u201d to make housing, healthcare and food more affordable.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>SUING TRUMP<\/strong><\/p>\n<h4>Colorado\u2019s current Attorney General Phil Weiser has sued the Trump administration at least 65 times, according to our tracker. Will pushing back against President Trump remain a top priority for the office if you\u2019re elected, or do you think the state should devote more of its resources to other issues?<\/h4>\n<div>\n<div>\n<p><strong>Jena Griswold<\/strong><\/p>\n<p>\u201cI will absolutely continue to pursue federal litigation against Donald Trump,\u201d Griswold said.<\/p>\n<p>\u201cI took action when Tina Peters compromised her voting equipment in an attempt to prove the big lie,\u201d she said. \u201cThe rule of law, our democracy, and our country is at extreme risk by this lawless president, and as attorney general, I will continue to stand up to Trump and MAGA extremists to protect our democracy and our rights.\u201d<\/p>\n<\/div>\n<div>\n<p><strong>David Seligman<\/strong><\/p>\n<p>\u201cWe have to hold the Trump administration accountable when it violates the law, and it hurts Coloradans,\u201d Seligman said. But, he said, the next attorney general also has to have a \u201cpositive vision for the future.\u201d<\/p>\n<p>\u201cWhether or not you voted for me, I\u2019m going to fight for your prosperity. And I\u2019m gonna do it by standing by your side when we take on the bullies of our society, the Goliaths, the wealthy, the powerful that crush us.\u201d<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>Michael Dougherty<\/strong><\/p>\n<p>\u201cProtecting Colorado will always be my top priority, and that includes standing up against the Trump administration or whoever\u2019s in the White House,\u201d Dougherty said. \u201cIf they\u2019re violating the rule of law and harming Colorado \u2014 that will always be my guide. It will never be done to get my face on cable TV.\u201d<\/p>\n<\/div>\n<div>\n<p><strong>Hetal Doshi<\/strong><\/p>\n<p>Doshi said she would sue the federal government when it does something unlawful that harms Coloradans\u00a0if it falls into one of two categories. \u201cNo. 1, it\u2019s one of our individual rights, liberties, or deeply held values, or No. 2, it has to hurt our economic interest,\u201d like withholding funding for food stamps.<\/p>\n<p>\u201cBut I feel incredibly strongly that if we spend all of our time just being anti-Trump, we are missing and abdicating our responsibility to lead in Colorado in terms of building that better future,\u201d she added.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>IMMIGRATION<\/strong><\/p>\n<h4>Should Colorado change its laws to either counter or assist President Trump\u2019s immigration crackdown? What changes do you believe are needed?<\/h4>\n<div>\n<div>\n<p><strong>Jena Griswold<\/strong><\/p>\n<p>\u201cI am fully supportive of banning masks outside of limited exceptions,\u201d Griswold said. \u201cIf we are seeing \u2014 and we are \u2014\u00a0illegal behavior, criminal acts, from federal agents, it\u2019s really important that masks are off.\u201d She said she would work with the legislature to ensure Coloradans can bring lawsuits against federal agents for violating their civil rights. And, she said lawmakers should explore prohibiting federal immigration enforcement on public property.<\/p>\n<p>\u201cICE is terrorizing cities,\u201d she said. \u201cThey\u2019re terrorizing this country and we have to put an end to that lawlessness.\u201d<\/p>\n<\/div>\n<div>\n<p><strong>David Seligman<\/strong><\/p>\n<p>\u201cI was deeply disappointed that the legislature rejected the No Kings Act this year,\u201d Seligman said. \u201cThat would have allowed people in Colorado to sue federal officials, including ICE officers, who trample our rights.\u201d<\/p>\n<p>But, he said, the attorney general\u2019s office already has the legal tools to \u201cbang down the door\u201d at immigration detention facilities with a subpoena in hand. \u201cPeople are getting treated with inhumane conditions, and we need to stand up for people.\u201d<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>Michael Dougherty<\/strong><\/p>\n<p>\u201dOne thing I want to see Colorado do is give the attorney general the authority to inspect immigrant detention facilities,\u201d Dougherty said. \u201cWe should have that here in Colorado, so that I, as attorney general, can address the inhumane conditions that immigrants are being subjected to and suffering from, and bring either civil rights violations and\/or criminal charges against the people working in those private prison facilities.\u201d<\/p>\n<\/div>\n<div>\n<p><strong>Hetal Doshi<\/strong><\/p>\n<p>Doshi said it was \u201cunacceptable that ICE agents that wear and carry a badge are masked, they are unidentified and they are violating core constitutional principles\u201d like entering people\u2019s homes without a warrant.<br \/>She said she would support \u201cevery effort that Colorado can make to pass constitutional legislation that holds federal agents to the same standards as Colorado state agents to make sure that our citizens are protected.\u201d<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>PROSECUTING ICE<\/strong><\/p>\n<h4>Would your office prosecute federal immigration enforcement officers accused of violating civil rights in Colorado?<\/h4>\n<div>\n<div>\n<p><strong>Jena Griswold<\/strong><\/p>\n<p>\u201cI will prosecute any ICE or federal agent that commits a crime,\u201d Griswold said. \u201cThe constitution does not disappear because someone is wearing a badge. They do not have immunity and I will hold them accountable.\u201d<\/p>\n<\/div>\n<div>\n<p><strong>David Seligman<\/strong><\/p>\n<p>\u201cYes, (I will) hold them accountable, prosecute them with whatever tools we have,\u201d Seligman said. \u201cI just think it\u2019s really important that we signal that no one is above the law.\u201d<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>Michael Dougherty<\/strong><\/p>\n<p>\u201cI promise you, I\u2019ll hold ICE accountable when they commit crimes in Colorado,\u201d Dougherty said. \u201cI\u2019m the one candidate in the race who\u2019s successfully prosecuted police officers, people in power and elected officials. And I\u2019ll hold ICE to the same approach, which is doing justice without fear and without favor.\u201d<\/p>\n<\/div>\n<div>\n<p><strong>Hetal Doshi<\/strong><\/p>\n<p>\u201cYes,\u201d Doshi said, but \u201cprosecuting a federal agent under criminal law is like the Super Bowl of criminal prosecutions. Truly, it is deeply complex and fraught.\u201d<\/p>\n<p>\u201cWhen we have to do it \u2014 not an if, based on what we saw in Minnesota \u2014 we need the most experienced lawyer at the helm.\u201d<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>LAW ENFORCEMENT &amp; ICE<\/strong><\/p>\n<h4>To what extent do you think Colorado law enforcement should assist U.S. Immigration and Customs Enforcement?<\/h4>\n<div>\n<div>\n<p><strong>Jena Griswold<\/strong><\/p>\n<p>\u201cI think Colorado law enforcement should follow the law,\u201d Griswold said. \u201cIt\u2019s very clear that law enforcement must not cooperate with ICE in most situations, and as attorney general, I will absolutely enforce the law. That\u2019s what the law is, that\u2019s what it should be, and people need to follow it.\u201d<\/p>\n<\/div>\n<div>\n<p><strong>David Seligman<\/strong><\/p>\n<p>\u201cNot at all.\u201d<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>Michael Dougherty<\/strong><\/p>\n<p>\u201cIt\u2019s prohibited by state law. Period,\u201d Dougherty said. \u201cIf you have a domestic violence victim, that person should be able to call 911, have the police respond, go to the hospital for treatment, and come to the courthouse, without fear that they and their kids are going to be deported. The job of local and state law enforcement, including district attorneys, is to do justice and to uphold public safety, not to do the job of federal authorities.\u201d<\/p>\n<\/div>\n<div>\n<p><strong>Hetal Doshi<\/strong><\/p>\n<p>\u201cI don\u2019t,\u201d Doshi said. \u201cI support the fact that Colorado law enforcement\u2019s resources are best suited to protecting Coloradans. That\u2019s the law in Colorado.\u201d<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>BALANCE<\/strong><\/p>\n<h4>How will you strike a balance between public safety, the rights of victims, and the civil rights of those accused of crimes?<\/h4>\n<div>\n<div>\n<p><strong>Jena Griswold<\/strong><\/p>\n<p>\u201cI don\u2019t think that they\u2019re in contention necessarily with one another,\u201d Griswold said. \u201cWe should always prioritize constitutional rights and civil rights. Healthy communities are communities where people\u2019s rights are being respected, and where people also feel safe in their communities. So I fundamentally believe that those two concepts are not at odds.\u201d<\/p>\n<\/div>\n<div>\n<p><strong>David Seligman<\/strong><\/p>\n<p>\u201cI don\u2019t see these as being in tension with one another,\u201d Seligman said. \u201cWhat we know is that mass incarceration in Colorado has failed. We need to move away from that model.\u201d<\/p>\n<p>He said the state needed to increase funding for mental health and substance abuse treatment. To fund it, he wants to create a community health and safety fund that would be paid for with enforcement actions against corporations.<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>Michael Dougherty<\/strong><\/p>\n<p>Dougherty pointed to his work on criminal justice reform, which includes leading the state\u2019s Sentencing Reform Task Force, and launching a mental health diversion program.<\/p>\n<p>\u201cIt\u2019s recognizing that we have behavioral health needs that often go untreated \u2014 Colorado languishes compared to other states in providing treatment to those in need,\u201d he said. \u201cBut it\u2019s also holding people accountable when they violate the rule of law. When crimes are committed, particularly serious crimes, making sure that justice is done in those cases, and I have a long history of doing exactly that.\u201d<\/p>\n<\/div>\n<div>\n<p><strong>Hetal Doshi<\/strong><\/p>\n<p>Doshi said she has experience balancing those considerations as a federal prosecutor. \u201cPublic safety issues can\u2019t just be addressed at the last stage of the process,\u201d she said. \u201dWe\u2019re not going to be able to resolve crimes arising from poverty by simply prosecuting those crimes.\u201d<\/p>\n<p>Instead, she said, she supports increasing mental health services and improving economic opportunities \u201cin conjunction with making sure that we go after the heads of organizations, cartels, and (criminal) conspiracies.\u201d<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>PRISON POPULATION<\/strong><\/p>\n<h4>Do you see a role for the attorney general\u2019s office in reducing incarceration and prison populations amid a state budget crisis?<\/h4>\n<div>\n<div>\n<p><strong>Jena Griswold<\/strong><\/p>\n<p>Griswold said \u201dit depends.\u201d<\/p>\n<p>\u201cEvery Coloradan has the right to live in a community free of crime, where they feel safe,\u201d she said. \u201cI will focus on addressing both the crime and the root causes of it \u2014 that includes mental health, drug addiction, gun violence, sexual assault.\u201d<\/p>\n<p>\u201cWe do have to ensure that people formerly incarcerated are reintegrated into communities in productive ways,\u201d she added.<\/p>\n<\/div>\n<div>\n<p><strong>David Seligman<\/strong><\/p>\n<p>Yes, Seligman said. \u201cI\u2019d make sure that we get people out of prison who are eligible for release \u2014 make sure they\u2019re on a pathway to \u2026 fulfilling, thriving lives.\u201d<\/p>\n<p>Seligman said the state needed to invest much more heavily in restorative justice programs, as well. \u201cThis is where the attorney general could be a really important voice in the legislature, to be a leader on fighting for a system that actually advances public safety.\u201d<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>Michael Dougherty<\/strong><\/p>\n<p>\u201cYes,\u201d Dougherty said. He said he plans to expand diversion programs and continue to work on sentencing reform in order to reduce prison populations. Dougherty also said he wants the state Department of Corrections to take over control of the state\u2019s private prisons.<\/p>\n<p>\u201cI can\u2019t emphasize enough how strongly I oppose private prisons,\u201d he said. \u201cThe reality that we still have two private prisons at the state level when we\u2019ve had a Democratic-controlled state House and Senate and governor\u2019s office to me is a failure. We should never have a for-profit corporation making money off the backs of those that are in their custody.\u201d<\/p>\n<p>Read more <a href=\"https:\/\/coloradorelocationreport.com\/?p=409\">How one place in Colorado achieved 100% clean energy this spring<\/a><\/p>\n<\/div>\n<div>\n<p><strong>Hetal Doshi<\/strong><\/p>\n<p>\u201cYes,\u201d Doshi said, adding that it\u2019s why she believes the attorney general needs to focus on economic issues, like enforcing antitrust and consumer protection laws. <br \/>She also said she wants to work with the legislature to increase funding for behavioral health and substance abuse treatment. \u201cIf we have a society that provides for a shot at the American dream, much like my family had, and a society that takes care of behavioral health issues, data shows us that is the best way to reduce crime in our cities and urban areas.\u201d<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>AI REGULATION<\/strong><\/p>\n<h4>Does Colorado\u2019s latest attempt to regulate artificial intelligence strike the right balance between consumer protections and innovation? If so, why? If not, what do you propose instead?<\/h4>\n<div>\n<div>\n<p><strong>Jena Griswold<\/strong><\/p>\n<p>Griswold said she expects the state to have \u201crepeated conversations\u201d over artificial intelligence in the coming years, and \u201cwe need to focus on making sure AI is not used in an unlawful way.\u201d<\/p>\n<p>She also said she\u2019s concerned about the impact of data centers. \u201cI will stand up to monopoly utilities and tech companies to protect water and to make sure that data centers are paying their own way so that Colorado families and small businesses don\u2019t have to foot the bill,\u201d Griswold said.<\/p>\n<\/div>\n<div>\n<p><strong>David Seligman<\/strong><\/p>\n<p>Seligman said there was \u201csome good stuff in the compromise,\u201d but there\u2019s a lot more to do. He said he would have preferred a deal that was in the works last summer that would have \u201csubstantially stripped the red tape that applies to small businesses,\u201d but added \u201cmeaningful liability up the chain for the wealthiest, most powerful corporations.\u201d<\/p>\n<p>\u201cWe need to make sure that the interests that are profiting off of the misuse of AI \u2026 are held accountable for the harms they cause us,\u201d Seligman added.<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>Michael Dougherty<\/strong><\/p>\n<p>Dougherty said lawmakers should have done more to find compromise before becoming the first state to pass regulations on AI.<\/p>\n<p>\u201cThe rush to pass the legislation on AI last year, it was problematic, and Colorado got too far out over its skis on that,\u201d he said. \u201cSo, I think whether or not it strikes the right balance is still a work in progress, quite frankly.\u201d<\/p>\n<\/div>\n<div>\n<p><strong>Hetal Doshi<\/strong><\/p>\n<p>Doshi said it\u2019s too early to say. \u201cThe devil\u2019s in the details in terms of what enforcement looks like, and how these cases hold up in court, and how good of a job we do separating honest conduct from cheating conduct,\u201d she said.<\/p>\n<p>\u201cWhat I have seen is that in my biggest cases \u2014 like cases against Google and Apple \u2014 it\u2019s actually other small- and medium-sized businesses that are coming to the table and saying, \u2018we\u2019re being squeezed out of the competitive process right now. We are dying for some enforcement.\u2019\u201d<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>ANTITRUST<\/strong><\/p>\n<h4>The antitrust movement has seen a resurgence across the country in recent years, with mixed results. If elected, will it be a major component of your office\u2019s work, or do you prefer to focus on other ways to protect consumers?<\/h4>\n<div>\n<div>\n<p><strong>Jena Griswold<\/strong><\/p>\n<p>Griswold said she will \u201cabsolutely pursue antitrust cases that affect everyday Coloradans,\u201d including price-fixing, healthcare consolidation and the use of algorithms to drive up rent.<\/p>\n<p>She also said it\u2019s important to prioritize consumer protection, pointing to her experience fighting fraudulent business filings as secretary of state. \u201cAs attorney general, I\u2019ll build on that by taking on price gouging, junk fees, predatory lenders, companies that are misusing Coloradans\u2019 personal data.\u201d<\/p>\n<\/div>\n<div>\n<p><strong>David Seligman<\/strong><\/p>\n<p>\u201cWith me as attorney general, Colorado will be a leading force across the country in the fight against monopoly power,\u201d Seligman said, adding that he would target monopolies in healthcare, housing and ski resorts, among other industries.<\/p>\n<p>\u201cThis is not just a problem of economics. It\u2019s also how working people have been left behind, even while we live in the wealthiest country in the history of the world,\u201d he said. \u201cIt\u2019s also a problem of our democracy, who has voice and who has power over their own lives. This is about everything. It\u2019s for all the marbles.\u201d<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>Michael Dougherty<\/strong><\/p>\n<p>Dougherty said antitrust enforcement would be a priority for his office, pointing to the case that blocked the grocery store merger between King Soopers and Safeway as an example of why it\u2019s needed.<\/p>\n<p>\u201cEspecially as we see a concentration of power in corporations, antitrust enforcement is going to be more important than ever at the state level, given that the federal government seems to be rolling back any regulation, and any response to what we\u2019re seeing across the country.\u201d<\/p>\n<\/div>\n<div>\n<p><strong>Hetal Doshi<\/strong><\/p>\n<p>\u201cWe are seeing in this moment a real understanding that economic opportunity and economic freedom is the key to our civil liberties,\u201d Doshi said. \u201cAnd therefore, I think antitrust has an important central role to play in the next attorney general\u2019s portfolio.\u201d<\/p>\n<p>She pointed to comedian and talk show host Jimmy Kimmel\u2019s suspension from ABC last year in the wake of pressure from the Trump administration. \u201cThat seemed to be a question around the First Amendment \u2014 and it was \u2014 but the constraints on the First Amendment were coming from incredible concentration of power with the broadcasting agencies.\u201d<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>ENVIRONMENT<\/strong><\/p>\n<h4>How will you protect the environment if elected?<\/h4>\n<div>\n<div>\n<p><strong>Jena Griswold<\/strong><\/p>\n<p>Griswold called environmental protection \u201ceven more pressing as the (federal Environmental Protection Agency) is being gutted,\u201d saying Colorado is already seeing the \u201ddangerous effects\u201d of climate change.<\/p>\n<p>\u201cI\u2019ll sue to stop Trump\u2019s effort to force Colorado to use dirty coal power and sell off our public lands,\u201d she said. \u201cI\u2019ll stand up to corporate polluters to make sure that our air and water is clean and that our outdoors are protected.\u201d<\/p>\n<\/div>\n<div>\n<p><strong>David Seligman<\/strong><\/p>\n<p>Seligman said the attorney general needs to do more than just represent the state\u2019s environmental agencies in court. Too often, he said, state regulators impose fines that amount to the equivalent of \u201ca parking ticket\u201d for oil and gas companies that make billions in profits.<\/p>\n<p>\u201dThe AG\u2019s office has the authority right now to go on offense, independent of the governor and the agencies of the governor,\u201d Seligman said. \u201cI\u2019d create an environmental justice and protection unit, bring together all of the civil authorities, all of the criminal authorities in Colorado law to make polluters pay meaningfully.\u201d<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>Michael Dougherty<\/strong><\/p>\n<p>Dougherty said the Attorney General\u2019s Office needs to hold corporations responsible by prosecuting environmental crimes and taking civil actions against polluters. He said he would ensure state regulators are \u201cputting people over profits and making sure we\u2019re not giving companies like Suncor a light slap on the wrist when they\u2019re polluting and harming communities of color.\u201d<\/p>\n<p>Dougherty also said he would protect Colorado\u2019s water from \u201cbuy and dry schemes,\u201d in which private equity firms buy the water rights from struggling communities, leaving less for farmers and ranchers across the state.<\/p>\n<\/div>\n<div>\n<p><strong>Hetal Doshi<\/strong><\/p>\n<p>\u201cThe state has both civil and criminal environmental tools available to it, and in an era of unprecedented rollback from the federal government, we\u2019re going to have to see an increase in the use of both of those types of tools,\u201d Doshi said.<\/p>\n<p>She said the state will have to step in on water policy, in particular, and push back against the federal government when it is \u201cactively making things worse\u201d by suspending pollution standards and bringing coal plants back online.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>CIVIL RIGHTS<\/strong><\/p>\n<h4>In recent years, the current attorney general created a new civil rights division, which is charged with enforcing state housing laws. What are your priorities for that unit? Do you think Colorado lawmakers have struck the right legal balance between tenants and landlords, or does one side need additional protections that they don\u2019t have today?<\/h4>\n<div>\n<div>\n<p><strong>Jena Griswold<\/strong><\/p>\n<p>Griswold said she would continue the fair housing unit\u2019s \u201creally important work\u201d cracking down on predatory practices by landlords and preventing discrimination.<\/p>\n<p>\u201cI will absolutely enforce laws to stop corporate landlords from illegal price fixing and from charging tenants junk fees month after month,\u201d Griswold said. She also promised to take action \u2014 if needed \u2014 to make sure local housing markets are competitive. And, she said she would defend state laws that help create new housing.<\/p>\n<\/div>\n<div>\n<p><strong>David Seligman<\/strong><\/p>\n<p>Seligman said his top priority is enforcing the existing laws with more urgency. \u201cIf your landlord isn\u2019t fixing the heat and it\u2019s the middle of winter, and you call government, you know what? We\u2019re going to show up in 24 hours,\u201d he said. \u201cWe\u2019re going to be banging on the door. We\u2019re going to make sure the landlord fixes the heat.\u201d<\/p>\n<p>He also said he would also support legislation banning private equity ownership of housing and allowing local governments to pass rent stabilization ordinances.<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>Michael Dougherty<\/strong><\/p>\n<p>Dougherty said the attorney general \u201dhas to be really aggressive\u201d in taking on unscrupulous landlords that tack on excessive fees to renters, pointing to his role in suing Four Star Realty over illegal tenant charges.<\/p>\n<p>But, he added, many of the state\u2019s business regulations have gone too far. \u201cIt makes it so hard for business owners and small businesses to survive.\u201d<\/p>\n<\/div>\n<div>\n<p><strong>Hetal Doshi<\/strong><\/p>\n<p>Doshi pointed to her role in filing the national lawsuit against RealPage over its use of an algorithm to increase rent prices. \u201cYou should expect to see me continue to prioritize systemic and structural issues in the housing space,\u201d she said.<\/p>\n<p>Doshi said there are always be more protections that could be helpful, but she will prioritize enforcing the laws Colorado already has. \u201cIt\u2019s often the poorest communities, often Black and brown communities, that suffer when people try to skirt those laws, and that\u2019s something that I\u2019m very committed to fighting.\u201d<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>TABOR<\/strong><\/p>\n<h4>If the state is sued over the Taxpayer\u2019s Bill of Rights, will you defend the 1992 constitutional amendment?<\/h4>\n<div>\n<div>\n<p><strong>Jena Griswold<\/strong><\/p>\n<p>\u201cYes,\u201d Griswold said. \u201cNo matter what my opinion is on TABOR, it is the law of the land. The Colorado Supreme Court has upheld its constitutionality.\u201d<\/p>\n<p>But, she added, \u201cit\u2019s also true that TABOR has created frequent damaging impacts on the services that Coloradans need. It\u2019s devastated the budget. It\u2019s prevented the state from making key investments in education, childcare, healthcare and infrastructure.\u201d<\/p>\n<\/div>\n<div>\n<p><strong>David Seligman<\/strong><\/p>\n<p>Seligman said he has \u201cserious concerns about TABOR\u2019s constitutionality and the ways in which it violates a republican form of government.\u201d<\/p>\n<p>\u201cI would not defend TABOR in court,\u201d he said. \u201cI think it is absurd and counter to our constitutional structure that our legislature is hamstrung from raising revenues because of a scheme where billionaires and corporations pay the same tax rate as you and me.\u201d Seligman said he would also work to convince voters to make changes to TABOR at the ballot box.<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>Michael Dougherty<\/strong><\/p>\n<p>Dougherty said he supports modifying TABOR. \u201cThe very things we need to improve our society, TABOR restricts or eliminates our ability to provide those things to people.\u201d<\/p>\n<p>But if he was asked to defend TABOR in court, Dougherty said \u201cit would depend on the specifics of the lawsuit. My hope is that since TABOR was enacted by the will of the voters, my idea would be that any changes come from the voters.\u201d<\/p>\n<\/div>\n<div>\n<p><strong>Hetal Doshi<\/strong><\/p>\n<p>Doshi said TABOR is \u201cproblematic\u201d because of the effect it has on public services, but she also supports letting voters have a say in tax increases. \u201cTo the extent that the actual TABOR is challenged in court, the facts and circumstances of how that comes before the court will inform my decision about how I handle that,\u201d she said.<\/p>\n<p>\u201cI have a voice and discretion, of course, as the next attorney general, but I think we have to be very careful about attorneys general that just casually say, \u2018there are some laws that I will not defend,\u2019 right? Because that can be a road to some really unwise outcomes,\u201d Doshi added.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>OTHER PRIORITIES<\/strong><\/p>\n<h4>Do you have any other priorities that I didn\u2019t ask about?<\/h4>\n<div>\n<div>\n<p><strong>Jena Griswold<\/strong><\/p>\n<p>\u201cI think we really touched on almost everything to tell you the truth,\u201d she said.<\/p>\n<\/div>\n<div>\n<p><strong>David Seligman<\/strong><\/p>\n<p>Seligman elaborated on his answer to the previous question regarding TABOR: \u201cThe Colorado Supreme Court has been perfectly clear about this: It is not the AG\u2019s responsibility to defend the state tooth and nail in every case. If I think TABOR is unconstitutional, it\u2019s part of my obligation to make that point and not defend it in court. And I do not think it is constitutional. But, let\u2019s beat it at the ballot box.\u201d<\/p>\n<\/div>\n<\/div>\n<div>\n<div>\n<p><strong>Michael Dougherty<\/strong><\/p>\n<p>Dougherty said it was critical to strike \u201cthe right balance between protecting our democracy and defending Colorado through this crisis period that we\u2019re living in, but also having a vision for the future.
